1.1 The owner and operator of the online store operating at www.hatfactory.pl is EVITA Smoderek Jarosław Smoderek Ewa Sp.J. with headquarters in Warsaw, ul. Zwycięzców 28/8, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court, 13th Commercial Division of the National Court Register under the KRS number: 0000079724, REGON: 02182590, NIP: 526-011-01-59.


1.2 The customer can contact the online store at HATFACTORY, ul. Zwycięzców 28/8, 03-938 Warsaw; by phone at 501-010-193 or via the contact form on the website of the online store.


2. The principles of operation of the HATFACTORY online store


HATFACTORY sells goods through an organized online store via the Internet. The sale includes goods available within the distribution network of EVITA Sp.J. or other brands of clothing for sale of which EVITA Sp.J. has the right.


3. Ordering goods


3.1. Orders are accepted via the website www.hatfactory.pl


3.2. The goods in the online store are marked in detail. The website contains information about the properties of the goods, their price, material, etc.


3.3. When ordering goods, the customer selects it in a manner appropriate for a given item, specifying in particular the size, color, and, if necessary, also providing other specific information and the number of items ordered.


4. How to buy in the online store - detailed instructions


4.1 After selecting the goods by the Customer, click the "Add to Cart" icon.


4.2 The product is transferred to the basket, which is visible after clicking on the basket icon in the bar at the top of the page. You can go to the basket by selecting the "Go to order processing" button, which opens a page showing all the products in the basket.


4.3 After selecting the "Order finalization" option, a page will appear where you must enter the Customer's data necessary to complete the transaction and ship the ordered goods.


4.4 By logging in, the Customer gains access to additional options such as: order history, the ability to check at what stage is the last, placed order, remembering shipping addresses, the ability to receive current information about products from the store.


4.5 After selecting the method of delivery (to the address provided or to be picked up at the HATFACTORY store) and entering all the necessary data (including invoice data, if applicable), select the payment method.


4.6 The customer can choose the online payment method (payment by credit card or transfer via Tpay / PayU / PayPal) or pay for the shipment on delivery.


4.7 The customer docks the order by clicking the "Order with payment obligation" button.


4.8 After clicking the "Place an order and pay" button, if the Customer has chosen to pay online, also after making the payment via Tpay / PayU / PayPal, the Customer is redirected to the page where he can continue shopping or go to the order summary.


4.9 If online payment is selected as a form of payment for the goods (bank transfer or payment by credit card via the Tpay / PayU / Paypal system), the payment instruction should be carried out immediately after placing the order. In the event of not receiving the payment to the account of EVITA SP.J. or intermediaries in the transaction (Tpay website), the order is not considered correctly placed, the contract will not be concluded and the order will not be processed. In such a situation, you can place the order again.


4.10 At each stage of placing an order, until the payment is made, you can cancel the order by ceasing to go through the next steps and leaving the subpage for placing orders. An order, the submission of which will not be completed by the customer, will not be completed.


4.11 Immediately after placing the order, an e-mail confirming the order will be sent to the Customer's e-mail address provided in the login details. In the text of the e-mail, the Customer will receive an individualized order number, the provision of which is possible, among others, determining the status of the contract.


4.12 HATFACTORY may contact the Customer at the e-mail address provided by the Customer or by phone to the contact telephone number provided by the Customer, in order to clarify doubts, confirm the order or in other matters related to the execution of the order.

5. Prices


5.1 The prices on the website given in Polish zlotys are gross prices, including VAT. The store system uses geolocation and if the customer uses a location outside the EU or VPN, the prices may be displayed incorrectly.


5.2 The price of the goods does not include the shipping cost, the amount of which depends on the chosen form of delivery and payment.


5.3 The price given on the website at the time of placing the order is the final price, binding for the Customer. After placing the order, the price of the ordered goods will not change, regardless of price changes introduced by HATFACTORY or promotional or sale campaigns launched.


5.4 HATFACTORY reserves the right to change the prices of goods in the online store, introduce new goods for sale, carry out and cancel promotional campaigns on the store's website, or make changes to them in accordance with the standards of the Civil Code and other legal provisions.


6. Availability of the ordered goods


6.1 Not all goods sold in the online store are available goods. Some goods are available on request, which is clearly stated in the product description.


6.2 In exceptional situations, e.g. when an order for the same goods is placed by many customers at the same time, it may happen that the goods will not be available. In this case, the customer will be informed about the inability to complete the order.


6.3 In the product card, information about the full range of sizes is made available to customers - currently unavailable sizes are also included in this list, however, they are clearly marked with a color other than the available sizes. A product in an unavailable size cannot be added to the basket, but it can be added to the wish list.


7. Inability to complete the order


In the event that a given product is out of stock or the order cannot be processed for any other reason, the Customer will be informed by e-mail or by phone about problems with the execution of the order and possible solutions.


8. Method of delivery and order fulfillment time


8.1 Deliveries of goods are carried out in Poland.


8.2 In the case of a shipment paid for on delivery, the order is transferred for execution immediately after its submission. In the case of online payment, the order is transferred for processing after confirming the payment to the account of EVITA Sp.J. (via Tpay / PayU / PayPal or by ordinary transfer).


8.3 If the selected goods are available and the Customer has chosen to deliver them to the address indicated or to the showroom, the goods will be sent to the Customer within a maximum of 4 working days from the date of the order being correctly placed. If you choose express shipping, the order is completed with high priority.


8.4 NOTE: If you choose online payment via the Tpay service (transfer or payment by credit card) as a payment method, the execution of the order begins after 100% of the payment for the order has been credited to the account of the online store or intermediaries, from that moment the deadline should be counted, during which the goods will be delivered to the courier.


8.5 Orders are delivered by a courier company - the estimated time of delivery is one business day from the day following the shipment. The total order fulfillment period should not exceed 7 business days from the date of the correct order placement.


9. Forms of payment for the order



9.1 Cash on delivery: payment is made to the courier upon receipt of the courier parcel.


9.2 Transfer: transfers accepted by HATFACTORY are the so-called quick transfers made using Tpay / PayU / PayPal or a traditional transfer. The feature of fast transfers from Tpay / PayU / PayPal is that after selecting this form of payment, the customer is redirected to the website of the bank selected from the list to make a money transfer.


9.3 HATFACTORY accepts traditional transfers


9.4 Payment card: The customer must have a card that enables online payments (whether a given card meets this condition, please check with the bank that issued the card). Payment by credit card takes place via PayPal


9.5 Attention! The Online Store will never send an email to the Customer with information that the payment account has changed, along with a request to make a traditional transfer. If the customer receives such an e-mail - do not make a payment or reply to it, please send an unchanged e-mail to HATFACTORY to the following address: info@hatfactory.pl


10. Sales contract


10.1 The information posted on the website of the store www.hatfactory.pl does not constitute an offer to conclude a contract in accordance with the provisions of the Civil Code.


10.2 The contract may be concluded in Polish.


11. Performance of the contract - deadline


Depending on the type of delivery option chosen by the Customer (standard, express or collection at the indicated stationary showroom), HATFACTORY undertakes to deliver the goods to the courier within 2 working days (in the case of express delivery) or up to 4 working days (in the case of standard delivery). or in the case of picking up the order in a stationary showroom), from correct placing the order or, in the case of the lack of goods or the impossibility of completing the order, to informing the customer about the lack of goods or the impossibility of completing the order within such time limit. Working days are counted from Monday to Friday, excluding Saturdays and Sundays and public holidays.


12. Delivery cost


12.1 Deliveries are made in Poland.


12.2 The cost of delivery depends on the chosen method of delivery and payment and amounts.


13. Withdrawal from the contract


13.1 The customer has the right to withdraw from the contract of sale of goods within 14 days, without giving any reason.


13.2 The withdrawal period will expire after 14 days from the day on which the Customer acquires, or a third party other than the carrier and indicated by the Customer acquires, physical possession of the goods.


13.3 To exercise the right to withdraw from the contract, the Customer must inform HATFACTORY ul. Zwycięzców 28 lok 8, 03-938 Warsaw, shop helpline: 501-010-193, about your decision to withdraw from the sales contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail).


13.4 The customer may use the model withdrawal form, which may be printed and completed. However, it is not obligatory. The withdrawal form is available on the website of the online store, in the "Shopping Guide", in the "Withdrawal form" tab.


13.5 The customer may also complete online and submit the withdrawal form, available with each order in the Customer panel. If the Customer uses this option, the Customer will be immediately sent a confirmation of receipt of the information about withdrawal from the contract by e-mail. The customer may also send any other unequivocal statement electronically.


13.6 In order to meet the deadline to withdraw from the contract, it is sufficient for the Customer to send information regarding the exercise of the Customer's right to withdraw from the contract before the deadline to withdraw from the contract.


13.7 In the event of withdrawal from the sales contract, HATFACTORY returns to the Customer all payments received, including the costs of delivering the goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest standard delivery method offered by HATFACTORY, immediately, and in any case not later than 14 days from the date on which HATFACTORY was informed about the Customer's decision to exercise the right to withdraw from the sales contract.


13.8 The reimbursement will be made using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agreed to a different solution. In any case, the Customer will not incur any fees in connection with this return.


13.9 Hatfactory may withhold reimbursement until receipt of the goods or until proof of sending back the goods is provided, whichever occurs first.


13.10 Items should be sent to the following address: HATFACTORY, ul. ul. Zwycięzców 28 lok. 8, 03-938 Warsaw, immediately, and in any case not later than 14 days from the date on which the Customer informed HATFACTORY about the withdrawal from the sales contract. The deadline is met if the customer sends back the item before the deadline of 14 days.


13.11 The customer is obliged to bear the direct costs of returning the goods.


13.12 The customer may also return the item in any showroom operating under the HATFACORY brand.


13.13 The customer is responsible for reducing the value of the item resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the item.

14. Complaints


14.1 The subject of sale are new products, without defects. In the event of defects in products, HATFACTORY is liable for defects.


14.2 Any item purchased in the HATFACTORY online store may be advertised in accordance with the applicable provisions of the Civil Code regarding warranty, if within two years of its delivery to the Customer, a defect is found which constitutes its non-compliance with the contract.


14.3 A complaint may be submitted at any store operating under the HATFACTORY brand (except for an outlet store) or by post.


14.4 In the event of a complaint by post, please indicate the reasons for the complaint and the information necessary to identify the order. The "Complaint" form (available on the website, in the Customer's panel, for each order) may be used to submit a complaint, which can be completed online or printed, and then sent back to the following address: HATFACTORY ul. ul. 14.5LPP enables customers submitting a complaint to return defective goods by courier at the expense of HATFACTORY. For this purpose, the Customer is required to fill in an electronic complaint form (available in the Customer's panel) and send information about completing the complaint form along with address data from where the courier should pick up the shipment with the advertised products.


14.6 HATFACTORY will consider the complaint within 14 days and inform the Customer about the method of its settlement.


14.7 If the complaint submitted by post is accepted, the Customer will receive a refund of the incurred, intentional costs of sending the defective goods to the e-shop.


14.8 If the complaint is not accepted, the goods will be returned to the Customer together with information about the unjustified nature of the complaint.


14.9 If a complaint is submitted at the HATFACTORY salon, after its consideration, HATFACTORY will enable the Customer to collect the goods or the amount of money together with the refund of costs, in the salon where the complaint was submitted


15. Order cancellation


15.1 The customer may cancel the order.


15.2 The customer has the option to cancel the order himself, within fifteen minutes of placing the order, in the Customer panel, in the "My orders" tab, by clicking the "Cancel order" button next to the order.


15.3 The customer has the option to cancel the order by contacting the Customer Service and via the contact form available on the website.


16. Final provisions


Each purchased product is accompanied by a fiscal receipt or a VAT invoice. EVITA Sp. J. is not responsible for providing incorrect customer data.


16.1. Processing of personal data


The Customer's consent to the processing by EVITA SP.J. personal data within the meaning of the Act of August 29, 1997 on the Protection of Personal Data (i.e. of 2002 Journal of Laws No. 101, item 926, as amended) is voluntary, however, the lack of consent to the processing of personal data makes it impossible performance of the contract and execution of the order.


16.2. Processing of personal data for marketing purposes


The customer may consent to the processing of his personal data for marketing purposes within the meaning of the Act of August 29, 1997. on the protection of personal data (i.e. from 2002, Journal of Laws No. 101, item 926, as amended) and entrusting them to a third party in order to provide the Customer with advertising materials and information about promotional and marketing campaigns and the operator of the online store - EVITA SP.J.


16.3. Personal Data Administrator


The administrator of personal data is EVITA SP.J. with headquarters in Warsaw at the following address: ul. ul. Zwycięzców 28 lok. 8, 03-938 Warsaw. Pursuant to the Act on the Protection of Personal Data, providing personal data is voluntary, and the Customer has the right to inspect his data and correct it, change it, as well as request its removal.

17. Black Weekend Promotion

Promotion "Black Weekend -10% for everything" cannot be combined with other promotions on the store. The rebate code is only activated for non-on-sale products.
